These Terms of Service ("Terms") govern your access to and use of the website located at canadianwatercompliance.ca (the "Site"), operated by Canadian Water Compliance ("Canadian Water Compliance," "we," "us," or "our").

By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Site.

1. Who may use the Site

You must be at least the age of majority in your province or territory of residence to use the Site. By using the Site, you represent that you meet this requirement and that any information you provide is accurate and complete.

2. The Site is informational

The Site is provided for general informational and marketing purposes. Any information about water testing, regulations, standards, contaminants, compliance obligations, or recommended practices that appears on the Site (including blog posts, service pages, FAQs, and downloadable resources such as the Legionella Compliance Readiness Checklist) is provided for general guidance only.

The Site does not provide professional, legal, regulatory, engineering, medical, or scientific advice. Regulations and best practices change, and every facility is different. You should not rely on the Site as a substitute for professional consultation, laboratory analysis, or independent verification of your compliance obligations.

3. Quote requests are not contracts

Submitting a quote request, contact form, or resource download through the Site does not create a contract for services. Any engagement of Canadian Water Compliance for water testing, sampling, laboratory analysis, reporting, or related services is governed by a separate written proposal, scope of work, statement of work, or service agreement signed or otherwise accepted by both parties.

In the event of any conflict between these Terms and a signed service agreement, the service agreement will govern with respect to the services covered by it.

4. Acceptable use

When using the Site, you agree not to:

  • use the Site in violation of any applicable law or regulation;
  • submit false, misleading, or fraudulent information through any form on the Site;
  • attempt to gain unauthorized access to the Site, its server, or any related systems or networks;
  • interfere with or disrupt the Site, including by introducing viruses, malware, or other harmful code;
  • use any automated means (bots, scrapers, crawlers, etc.) to access, copy, or harvest content from the Site without our prior written permission, other than standard search engine indexing;
  • copy, reproduce, modify, distribute, sell, or create derivative works of any part of the Site, except as expressly permitted in Section 5; or
  • use the Site or any of our content to compete with us or in any way that could damage our reputation or business.

We may suspend or terminate your access to the Site at any time, without notice, if we believe you have violated these Terms.

5. Intellectual property

The Site and all of its content — including text, graphics, logos, images, photographs, videos, downloadable resources, page layouts, and the underlying code — are owned by Canadian Water Compliance or its licensors and are protected by Canadian and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and view the Site for your personal or internal business purposes. You may download or print resources we make available (such as the Legionella checklist) for your own internal use, provided you keep all copyright and other notices intact.

"Canadian Water Compliance" and our logos are trademarks of Canadian Water Compliance. You may not use them without our prior written consent.

6. User submissions

If you submit information to us through a form, email, or other channel — including names, contact details, facility details, testing requirements, or feedback — you represent that you have the right to share that information and grant us the right to use it for the purposes described in our Privacy Policy and to respond to your request.

Please do not submit confidential or highly sensitive information through the Site. Any non-confidential ideas, suggestions, or feedback you send us may be used by us without restriction or compensation.

7. Third-party links and content

The Site may include links to third-party websites, regulations, standards, or resources. These are provided for convenience only. We do not control, endorse, or take responsibility for the content, accuracy, or practices of third-party sites. Accessing any third-party site is at your own risk.

8. Disclaimers

To the fullest extent permitted by applicable law, the Site and all content, materials, and resources made available through it are provided "as is" and "as available," without warranties of any kind, whether express, implied, statutory, or otherwise. We disclaim all such warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, currency, and uninterrupted or error-free operation.

We do not warrant that the Site will be available at any particular time, that defects will be corrected, or that the Site or its server are free of viruses or other harmful components.

Nothing in this section limits any warranties or rights that cannot be excluded under applicable law, including the Consumer Protection Act, 2002 (Ontario) where it applies.

9. Limitation of liability

To the fullest extent permitted by applicable law, in no event will Canadian Water Compliance, its directors, officers, employees, contractors, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, business, goodwill, or anticipated savings, arising out of or in connection with your use of, or inability to use, the Site or any content on it, even if we have been advised of the possibility of such damages.

Our total aggregate liability arising out of or in connection with your use of the Site is limited to one hundred Canadian dollars (CAD $100).

This section does not apply to liability that cannot be limited or excluded under applicable law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Canadian Water Compliance and its directors, officers, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any applicable law or third-party right.

11. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect and handle personal information through the Site.

12. Changes to the Site and these Terms

We may modify, suspend, or discontinue any part of the Site at any time without notice. We may also update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Your continued use of the Site after a change takes effect means you accept the updated Terms. If you do not agree, you must stop using the Site.

13. Governing law and jurisdiction

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the courts located in Toronto, Ontario, and you consent to the personal jurisdiction of those courts.

14. General

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force. Our failure to enforce any provision is not a waiver of our right to do so later. These Terms, together with our Privacy Policy and any signed service agreement, are the entire agreement between you and Canadian Water Compliance regarding your use of the Site. You may not assign these Terms without our prior written consent.
